Evading Military Service Yoo Seung-joon Is Finally Abandoning Entry...No longer important to the Justice Department's entry ban



Yoo Seung-joon, who was banned from entering the country on charges of avoiding military service, left a meaningful post.

Yoo Seung-joon gave up his Korean citizenship and obtained U.S. citizenship after leaving for the U.S. in 2002, saying he would return from an overseas performance before serving as a public service worker. Accordingly, the Ministry of Justice and the Military Manpower Administration banned Yoo Seung-joon from entering the country.

However, Yoo applied for an overseas Korean visa (F-4) to the Consulate General in Los Angeles in 2015. The Consulate General refused to do so, and Yoo Seung-joon filed a lawsuit to cancel the denial of visa issuance. The first and second trials ruled against the plaintiff, but the Supreme Court raised Yoo Seung-joon's hand and decided to destroy and repatriate him, and in the end, the revocation and repatriation trial ended in Yoo Seung-joon's victory. In response, Yoo Seung-joon applied for a visa again, but the Consulate General of LA refused to issue a visa, saying, `There is a risk of harming the national interest.' Yoo Seung-joon filed a second lawsuit in October 2020, and reached an appeal trial and was ruled to cancel the denial of visa issuance. However, the Consulate General of LA refused to issue a visa again in June last year, and Yoo Seung-joon filed a third lawsuit in September of the same year.

On the 20th, the 5th Division of Administration (Chief Judge Lee Jung-won) of the Seoul Administrative Court held the first hearing of Yoo Seung-joon's lawsuit against the Consulate General of LA and the Minister of Justice to confirm the absence of the entry ban.




Yoo Seung-jun's side continued to be denied issuance because the Ministry of Justice's decision to ban entry was valid even though the Supreme Court's judgment had to issue a visa"He insisted that the 2002 decision to ban entry be nullified.

However, the Ministry of Justice countered that there is still a need to ban entry, saying that Yoo Seung-joon's entry could affect national interests and public welfare, apart from the old Overseas Koreans Act, which stipulates that even if he loses Korean nationality for the purpose of avoiding military service, he can be granted a residence status for overseas Koreans at the age of 38.

The court decided to hold another hearing on May 8 before closing the trial.
