The Civil Agreement Department 52 of the Seoul Central District Court announced on the 30th that it has decided to accept the indirect compulsory application filed by Adore against Newzins.
Indirect coercion is an execution method that indirectly induces the debtor to perform the debt by applying psychological pressure to the debtor if the debtor does not perform the debt arbitrarily.
It is one of the civil execution methods that forces the debtor to perform the debt psychologically.
The court shall not engage in entertainment activities without prior approval or consent from Adore until the judgment of the first instance of the lawsuit for validation of the exclusive contract is made"In case of a violation, pay KRW 1 billion each to the adore."
This prevented Newzins from doing any independent activities without an agreement with Adore. All of them have to pay 5 billion won in compensation at a time when they engage in independent activities regardless of the door.
The court took issue with Newzins' independent activities in Hong Kong as the NJZ. The court said "Newzins participated in an overseas concert on March 23, just two days after the date of the provisional injunction, and performed under a new group name, NJZ, and it is recognized that they released a new song at the time of the performance.", he pointed out.
In this way, it was determined that there is a possibility of violating the above obligations in the future because it directly or indirectly expressed its intention to act independently before and after the provisional decision, and violated the obligations set out in the provisional decision by performing under a new group name and releasing new songs. The Tribunal therefore needs to order indirect coercion against Newzins to enforce the fulfillment of the obligations set out in the provisional injunction decision," he stressed.
In the midst of this, Newzins, who had recently been absent, reportedly went on a trip to Australia. There are a series of sightings from Australian fans.
One fan commented "Hani, a Vietnamese-Australian, offered New Jeans members a trip to Australia, Minzy even brought her sister and is having a warm and special trip like a big family trip," he said.
Another Australian fan watched the Newgins in Melbourne. I couldn't take a picture because I was traveling privately. Newzins told me to travel well", leaving an unexpected encounter in the community. Another fan commented "On the last day of Melbourne, I was at a cafe with my friends, and when someone spoke in Korean next to me, I turned my head and met Hye-in's eyes. Hye-in was thin and tall, had white skin, small hair, and wore glasses. The way he spoke was very soft." Another fan said, "Minji Hani got an autograph and a hug from Daniel Hyein.""After certifying the signatures of the members, "Harin went to the bathroom and couldn't get it," he said.
Currently, Newzins and Adore are large lawyers with a large number of big names at large law firms and are preparing for the next court battle. On the 9th, Newzins submitted an additional letter of designation of the attorney in charge in connection with the lawsuit for validation of the exclusive contract (the original lawsuit) filed by Adore. In addition, Park Hyung-nam, a lawyer representing the law firm, who served as the head of the Judicial Policy Institute after serving as a senior judge at the Seoul High Court, was appointed to present a total of 14 lawyers.
Adore, who appointed Kim & Chang's law firm as his legal representative, put forward 13 lawyers, including Kang Il-won, former Constitutional Court justice, and Chun Ji-sung, the daughter of former Justice Minister Chun Jung-bae.
The second date of the main lawsuit was set for June 5.
