Park Seo-jun Wins Portrait Rights Lawsuit Against Restaurant Over Unauthorized Ads

The agency said it was a legal response to long-standing unauthorized use and repeated neglect of requests.
According to the Herald Economic Report on the 3rd, the Seoul Eastern District Court's Civil Affairs Department 13 (Judge Seok Joon-hyeop) ruled that Park Seo-jun should compensate Park Seo-jun for 5 million won in a lawsuit for damages filed against the restaurant owner A.
The incident began at a restaurant where the tvN drama 'What's Wrong with Secretary Kim' was filmed in 2018.
In the play, Park Seo-jun played a scene where he ate soy sauce marinated crab, and the restaurant owner used this scene to make a banner with the words 'Soy sauce marinated crab restaurant where Park Seo-jun ate a storm' and posted it inside and outside the restaurant for about five years. He also ran a portal site search advertisement for six years
Park Seo-jun has requested to stop the advertisement several times since 2019, but the restaurant claimed that it repeated its malicious behavior, such as pulling down the banner and re-installing it and not even responding afterward.
In response, Park Seo-jun's agency Awesome ENT reported that the estimated damage converted based on the advertising model fee was KRW 6 billion, but the actual claim was KRW 60 million considering the size of the other party's business", he explained.
The agency also said that malicious ridicule and second slander continue even after the court ruling""We will respond strongly to the infringement of the right to portrait and personal rights without leniency or agreement " he stressed.
The court acknowledged the infringement of Park Seo-jun's portrait rights, but limited the amount of damages to 5 million won in consideration of the size of the restaurant and the type of business. The ruling was confirmed because both sides did not appeal.
Meanwhile, Park Seo-jun is currently starring in the JTBC drama 'Waiting for Gyeongdo'.
