On the 3rd, the Supreme Court Division 1 (Chief Justice Ma Yong-joo) rejects the prosecutor's appeal in the appeal of Yoo Ah-in, who was charged with violating the Narcotics Control Act", and confirmed the lower court's sentence of one year in prison, two years of probation, and a fine of 2 million won.
As a result, infants will not be imprisoned in detention centers again.
Yoo Ah-in was indicted without detention in October 2023 on charges of 181 doses of propofol between September 2020 and March 2022, and of illegally prescribing sleeping pills 44 times in the name of another person between May 2021 and August 2022.
In January 2022, he was accused of smoking hemp in the U.S. and teaching his acquaintances to smoke hemp, and being investigated by the police on drug charges, teaching the destruction of evidence and urging a YouTuber who told the police about his marijuana smoking to reverse his statement.
In response, the first trial sentenced Yoo Ah-in to one year in prison and a fine of 2 million won on September 3 last year and arrested him in court.
The court pleaded guilty to smoking marijuana by infants, taking habitual medical drugs, and buying habitually in other people's names, but found the charges of smoking marijuana teachers and destroying evidence not guilty.
Yoo Ah-in and the prosecution appealed against the ruling of the first trial.
However, at the appeal trial, some of Yoo Ah-in's claims that the sentence was heavy were accepted, and he was released five months later after being reduced to one year in prison and two years of probation.
The appeals court said, `Although the crime is poor, the sentence is appropriate considering that the defendant suffered from sleep disorders and depression, has no intention of recidivism, and has already had time to reflect on himself while imprisoned for five months.'
