On the 28th, a first trial hearing was held at the Seoul Administrative Court to confirm the absence of the entry ban decision filed by Yoo Seung-joon against the Ministry of Justice and the Consulate General of Los Angeles.
On this day, the court ruled that Yoo Seung-joon's refusal to issue a visa should be canceled. The court stated that `It is difficult to say that Yoo Seung-joon's actions and actions may harm the interests of the Republic of Korea's security, maintenance of order, and diplomatic relations, and when comparing the public and private interests that can be obtained by banning Yoo Seung-joon from entering the country, the degree of damage to Yoo Seung-joon is greater, which violates the principle of proportionality. Even if Yoo Seung-joon is allowed to enter the country and stays in Korea, there is no concern that Yoo Seung-joon's existence or activities will cause disadvantages or safety in Korea. There is no reason for the rejection (visa issuance) and it is illegal due to deviant abuse of discretion, so (visa issuance rejection) should be canceled.
With this, Yoo won his third administrative lawsuit. Yoo Seung-joon was banned from entering the country in 2002 because he gave up his Korean nationality and obtained U.S. citizenship after leaving the country, saying he would perform overseas before joining the military. Yoo Seung-joon applied for a visa for overseas Koreans to the Consulate General of LA in 2015 When he was rejected, he filed a lawsuit to cancel the denial of visa issuance. In the two lawsuits, Yoo was ruled in favor of both. However, the Consulate General of LA once again refused to issue Yoo Seung-joon's visa last year, and Yoo once again won the case after filing a third lawsuit.

During the proceedings, the Ministry of Justice has maintained its stance against entry, saying, `The entry ban is at the discretion of the Minister of Justice and social confusion is expected if Yoo Seung-joon enters the country.' In other words, just because Yoo Seung-joon won the administrative lawsuit does not mean that he has destroyed the iron fortification of the Ministry of Justice.
In any case, as Yoo Seung-joon wins once again, attention is being paid to whether he will be able to go to Korea for the first time in 23 years.
