On the 30th, the 41st Division of Civil Agreement (Chief Judge Chung Hoe-il) of the Seoul Central District Court ruled in favor of the plaintiff at the trial of Adore's exclusive contract validation lawsuit against the members of Newgens.
On this day, the court said, `The dismissal of Min Hee-jin, former CEO of Airdor, alone cannot be considered to have created a gap in the management for Newgene's or common sense of Airdor's ability. Even if he was dismissed from his position as CEO, former CEO Min resigned himself even though he was able to participate in producer work as an outside director. It was Min who started a public opinion campaign for independence, not for the purpose of protecting Newzins, and the evidence submitted alone does not suggest that Hani heard remarks from the ILLIT manager that violate his personal rights, such as 'Ignore you'."I didn't accept all of Newzins' main arguments.
The court said "It cannot be considered that exclusive activities have been forced or that personal rights have been violated just because unreasonable demands have not been accepted. The trust relationship between Adore and Newzins is so broken that it is difficult to maintain the contract that it cannot be seen as a reason for the termination of the exclusive contract.
In response, Newzins' legal representative, Sejong, said, `I respect the court's judgment, but it is impossible to return to the company and continue normal entertainment activities at a time when the trust relationship with the company has already been completely broken. Members will immediately appeal the ruling of the first instance and hope that the Court of Appeal will once again comprehensively examine the facts and the legal principles regarding the termination of the exclusive contract to make a wise ruling" he said.
In November last year, Newzins declared its independent activities, saying that the exclusive contract was terminated due to Ador's breach of contract, but the court suspended the activities after accepting the application for injunction and indirect compulsory application for the prohibition of signing the contract, such as preserving the status of the agency and advertising contracts.
