According to the legal community on the 2nd, the Civil Affairs Department 37 of the Seoul Central District Court (Chief Judge Lee Sang-won) lost the plaintiff in a lawsuit filed by Cho Byung-kyu and his former agency HB Entertainment against A, who exposed the alleged school violence. The court dismissed all Cho Byung-kyu's claims. In addition, Cho Byung-kyu decided that the cost of the lawsuit was unfair.
Cho Byung-kyu claimed that `A defamed him by writing false information' and suffered a loss of KRW 4 billion due to the dropout of the advertising model and the cancellation of appearances in commercials, dramas, movies, and entertainment shows" he said. On top of that, A filed a lawsuit to compensate for the total amount of 200 million won in alimony. Cho Byung-kyu and HB Entertainment appointed a lawyer and submitted evidence, but A did not take legal action and did not submit documents to refute. The court cannot conclude that the contents of A's post are false only with the evidence submitted by Cho" came to a conclusion.
In addition, the court said that Cho's acquaintance appeared to have talked with A about the incident over six months, but the message acknowledging that A posted false information to his acquaintance was not submitted as evidence. From Cho's point of view, it seems that he could have collected enough related data through an acquaintance, but if A admitted it was false, he would have submitted it as evidence."
Cho Byung-kyu claimed that `A admitted that it was false that A deleted the article,' but the court refused to accept it and deleted the post in fear of having to listen to Cho's legal representative's opinion and respond to the complaint and a lawsuit for massive damages. In Korea, we cannot rule out the possibility that he felt more afraid to learn that defamation can also be punished in fact", he pointed out.
In addition, Cho Byung-kyu submitted statements from more than 20 acquaintances containing the denial of school violence as evidence, but it was not recognized as evidence. The court said "These are all people that Mr. Cho had a relationship with in Korea. It is difficult to confirm the facts of the events in New Zealand through them.
Cho Byung-kyu has appealed against this. The second trial will be held at the Seoul High Court.
In February 2021, A posted an article online claiming to Cho Byung-kyu that he suffered from school violence while studying in New Zealand. A claimed that he was beaten by Cho Byung-kyu and had to pay for snacks and karaoke instead. Cho Byung-kyu's side has completely denied the allegations and is taking legal action.
