Yoo Seung-joon Appeals Despite Winning His Third Visa Case in the First Trial...Consul General of L.A.



The third lawsuit over singer Yoo Seung-joon's issuance of a visa to enter Korea has been judged by the appeals court.

According to the legal community on the 18th, the Consulate General of Los Angeles (LA) filed an appeal against the Seoul Administrative Court's recent ruling to cancel Yoo Seung-joon's refusal to issue a visa.

Earlier, the Seoul Administrative Court's Administrative Division 5 (Chief Judge Lee Jung-won) ruled in favor of the plaintiff in a lawsuit filed by Yoo Seung-joon on August 28 to cancel the denial of visa issuance.




At that time, the court said that the Consulate General's claim that it is likely to harm the security, maintenance of order, and public welfare of the Republic of Korea is not recognized as a reason. It is contrary to the principle of proportionality because the plaintiff's disadvantage is too great than the public interest obtained by visa denial"I judged. However, "This conclusion does not mean that Yoo Seung-joon's actions in the past were appropriate."

Yoo Seung-joon, who debuted in 1997 and gained popularity with hits such as 'Nana'Scissors'I Love You Noona', was embroiled in a controversy over his avoidance of military service when he gave up his Korean nationality and obtained U.S. citizenship before joining the military in 2002, and was banned from entering the country by the Ministry of Justice. Later, in 2015, he applied for an overseas Korean (F-4) visa, but the Consulate General of LA refused, and won the Supreme Court's final victory in the first lawsuit. However, when the Consulate General refused to issue visas again, it led to a second lawsuit, which also ruled in favor of Yoo Seung-joon at the appeals court and the Supreme Court.

Nevertheless, the Consulate General of LA refused his visa again in June last year, and Yoo Seung-joon filed a third lawsuit and won the first trial, but the Consulate General appealed and an appeal is currently underway.




On the other hand, a separate lawsuit filed by Yoo Seung-joon saying, "(The Ministry of Justice's 2002 decision to ban entry is invalid") was dismissed, and the entry ban is still being maintained. Although the visa lawsuits have been won one after another, the possibility of actual entry remains unclear as long as the decision to ban entry remains in effect.
