EXO-CBX (Chen Baekhyun Xiumin) Sosogar INB100 met directly with SM Entertainment (SM) on July 9 to confirm the direction and will of the agreement on EXO's entire activities, and on September 10, they shared a detailed agreement and entered a practical negotiation stage. After the 2nd adjustment date (2nd), all conditions suggested by SM were accepted and the agreement was clearly communicated. I've been waiting for SM's final reply with all personal schedule left blank for December. We plan to reach an agreement as soon as possible in earnest for EXO's activities as a whole.
In other words, the city of Chenbaek is in the position that it has accepted all key provisions such as dropping all SM-related lawsuits and paying 10% of sales in the contract for 'EXO'.
SM immediately refuted this.
The SM said "We have made it clear to the three parties that the agreement on the settlement of the dispute and team activities are separate issues."
"In connection with the conclusion of the dispute, the Company has won all disputes so far, and what we asked the three parties to do was to pay 10% of the sales of individual activities as set out in the existing agreement dated June 18, 2023. This has not yet been implemented", he said. "The issue of participation in team activities was not only due to the collapse of trust between the two sides, but also the damage caused to EXO and the damage to fans and members, so it was only natural that serious efforts from the three sides to implement the existing agreement and restore trust were preceded.'
SM filed an objection first on the 16th, unlike the announcement that the three parties accepted all the conditions proposed by the company after the second mediation date on the 2nd and clearly communicated their intention to agree. We are deeply sorry for the announcement made by the trio that distorted this situation. "We will do our best to support and work hard for EXO's activities that will begin in December." declared.

Chenbaek City notified SM of the termination of the exclusive contract in 2023, but in the end, they mutually agreed with SM on the condition of consulting and revising some provisions. CBX founded its agency INB100, which joined as a label under One Hundred in 2024.
Later, Chenbaek City claimed that SM made unreasonable demands, such as asking for 10% of sales of private corporations, and SM countered that Chenbaek City was nitpicking by raising issues related to the provision of settlement data without complying with the agreement.
In response, SM filed a lawsuit against Chenbaek City for the performance of the contract worth 600 million won. The civil suit went into court mediation, but both the first mediation in September and the second mediation on the 2nd broke down. The court recommended compulsory mediation, but SM and Chenbaek City submitted an objection on the 16th.
Separately, CBX did not comply with the terms of the agreement (the 5.5% music distribution fee) of June 25, 2024He filed a complaint against SM CAO Lee Sung-soo and CEO Tak Young-joon on charges of violating the law (fraud) on aggravated punishment of specific economic crimes, but both the police and the prosecution cleared him of charges.
Chenbaek City applied to the Seoul Eastern District Court for an order to submit documents on all exo activity settlement data for 13 years and applied for an injunction on reading and copying all documents, including accounting books related to settlement, but the first trial, appeal, and the Supreme Court all rejected it.
In addition, the city of Chenbaek reported SM to the Ministry of Culture, Sports and Tourism for violating its obligation to disclose accounting books, but ended it with no violation. The Fair Trade Commission also refused to accept Chenbaek City's claim that it had reported an exclusive contract with SM and ended it without charge.
