The 12th Criminal Department of the Seoul Eastern District Court (Judge Lee Jung-hyung) ordered B, who was charged with violating the Special Act on the Punishment of Sexual Violence Crimes (threatening to use filming) and property damage, to take two years of probation and 40 hours of sexual violence treatment classes, and to restrict employment for four years at child and youth-related institutions and disabled institutions.
B dated A for about a year and four months from November 2020 to March 2022. However, B changed his face when his relationship with A faltered.
On December 10, 2021, Mr. B stole a picture of Mr. A's face and opened an SNS account and 'Stop being an idol. He sent a message and a video of sexual intercourse saying, 'There must be only the military now.' On January 4th, 2022, I also sent a message that 'We will upload all our photo videos and tag them'
B was also accused of throwing and destroying A's cell phone while arguing with A on a road in Buk-gu, Gwangju, on December 31, 2021.
The court saw that "B threatened to prevent the road ahead by distributing a sex video with A, and the guilt is not light."" He also admitted that `A felt considerable mental pain such as betrayal and anxiety, shame and discomfort.'
However, the fact that B admitted and reflected on all the crimes, that A dropped the complaint in agreement with A, and that he did not distribute the actual video served as sentencing factors.
