On the same day, the Suwon District Court's Criminal Appeals Department 6-2 (Chief Judges Kim Eun-jung, Kang Hee-kyung, and Kwak Hyung-seop) reversed the court case and acquitted A, an elementary school special teacher, who was charged with violating the Special Act on the Punishment of Child Abuse Crimes.
The incident began in September 2022 when Joo Ho-min and his wife recorded a classroom class by putting a recorder in their children's coat. In this recording, the special teacher, Mr. A, is "Very foul-mouthed","I hate it", It contained remarks made to children, such as "I hate you, too", and based on this, special teacher A was charged with emotional abuse.
The first trial court recognized the evidence capability of the recording and suspended the sentence of KRW 2 million, but the second trial court acquitted him, judging that the recording constitutes a dialogue between others that has not been disclosed under the Communications Secret Protection Act and cannot be used as evidence.
A's legal representative said, "This ruling is a wake-up call that if there is a conflict with a teacher, you should try to talk first. It will not be a reckless secret recording, but an opportunity for teachers to teach children in a stable educational environment."
