The case of a special teacher A, who was acquitted by an appeals court after being accused of emotionally abusing the son of famous webtoon writer Joo Ho-min, will be judged by the Supreme Court. This is as the prosecution filed an appeal against the appeals court's ruling.

According to the legal community, the Suwon District Prosecutors' Office submitted an appeal to the court on the 19th. As a result, the case was transferred to the Supreme Court.

Earlier on the 13th, the Suwon District Court's Criminal Appeals Department 6-2 (Chief Judges Kim Eun-jung, Kang Hee-kyung, and Kwak Hyung-seop) acquitted A, who was handed over to trial on charges of violating the Special Act on the Punishment of Child Abuse Crimes. This is the opposite of the first trial's suspension of the sentence of a fine of 2 million won.




Special teacher A told Joo Ho-min's son B (then 9 years old) during a class in a customized study class at an elementary school in Yongin, Gyeonggi Province, in September 2022, "What's in his head?" "I hate it. He was charged with emotional abuse by saying, `I hate you, too.'

The key issue in this case was the ability to prove the conversation recorded by Joo Ho-min's wife secretly putting it in her child's clothes. The Appeals Tribunal determined that the recorded file corresponds to a "disclosed conversation between others" and cannot be used as evidence because it may violate the Communications Secret Protection Act. He added that secondary evidence such as complaints prepared based on the recorded contents, statements of victims, and court testimony of the lower court cannot all be recognized as evidence.

The court also said that "Mother's actions are legitimate acts and are excluded from the illegality."The prosecution also refused to accept the claim.




On the other hand, the first trial was justified because it was a recording aimed at confirming the circumstances of abuse against the victim", accepted the ability to testify, and suspended the sentence of a fine of 2 million won to A.

In both the first and second trials, the prosecution demanded 10 months in prison and 3 years of restriction on employment at child-related institutions.

Joo Ho-min acquitted A by judging the legal effect of the evidence proving it rather than dealing with abuse. The result was different from our wishes, but we respect the court's decision.
