According to the legal community, the Seoul High Court's 11-3 Criminal Department will hold its first trial date on the 17th for violating the Special Act on the Punishment of Sexual Violence Crimes by a total of three people, including Taeil.
Hong, who was indicted along with Taeil, submitted a letter of apology once on the 25th. The remaining two did not submit.
Earlier, the 26th Criminal Department (C) of the Seoul Central District Court sentenced Taeil and three others accused of violating the Special Act on the Punishment of Sexual Violence Crimes (special rape) to three and a half years in prison in the first trial and arrested them in court. In addition, he ordered the completion of a 40-hour sexual violence treatment program, notification of personal information disclosure, and five-year employment restrictions for children and adolescents-related institutions.
The justice department said "The victim was drunk and was unable to resist, and the nature of the crime was very poor."The victim is a foreign traveler who seems to have suffered a lot mentally from a crime in an unfamiliar place."
However, he explained that all the defendants were first-time offenders and admitted to the crime, and that they did not want punishment in agreement with the victim.
Taeil was indicted without detention in March last year on charges of sexually assaulting a drunk foreign woman with two friends on June 13 last year. After being summoned for the first time in August of the same year, his agency SM Entertainment removed Taeil from NCT and terminated his exclusive contract.
Since then, all three people, including Taeil, have admitted to the crime and appealed for leniency at the trial date. Taeil's side appealed for leniency, saying, "I am deeply reflecting upon the fact that I have left a deep wound to the victim. In the aftermath of this incident, my mother quit her job, and Taeil is only engaged in economic activities that help her with work at an acquaintance's restaurant, so I am struggling to make a living for my family."
Taeil also bowed his head in his final statement, saying, `If you give me leniency, I think it's the last opportunity in my life, and I'll do my best to do anything that helps society even a little.'
The prosecution had demanded a seven-year prison term for Taeil and others, saying, `The case is very serious and the crime is extremely poor due to the case of taking a foreign tourist in a natural place and polishing it as a group.'
